Planning Board Minutes – May 14, 2019

Minutes of April 23, 2019: Urie – Motion to approve as amended, Phelps – Second, Vote – Unanimous to approve as amended

Non-Binding Consultation:  Jon Champagne and Nan Champagne Davis – a request for two additional driveways for access to Nan Champagne Davis’ property located at 435 Bay Road, Tax Map 4, Lot 20,092 in the Forest / Agricultural ZoneThere is currently twenty-seven acres on the property and the end goal is to subdivide into three lots of ten acres, ten acres and seven acres. Two driveway permits were requested of Road Agent Jon Thompson who advised that they needed to come before the Planning Board.  The property has at least 500 (five hundred) feet but no more than 1,000 (one thousand) feet of road frontage. The lot as it currently exists could have one additional driveway (for a total of three but NOT more than that (specifically not four).

There are currently 4 (four) access points to the property. If this is true, only 3 (three) driveways are allowed. Teach asked for details for a subdivision and advised a Special Exception would be needed from the Zoning Board of Adjustment if there are plans to build a home as the property is in the Forest and Agricultural Zone.

Dan Merzi – Excavation business review and approve the noise levels for final site plan approval for property at 14 Potters Lane, Tax Map 28, Lots 059,160 and 085,090


Moyer stated she had received the previously requested noise levels as the final information at the November 13, 2018 public hearing.  The information provided to the Planning Board did NOT establish that the noise levels of the crusher would not exceed 60 decibels at the property line. Instead the information neither told us how far away from the machine the noise level would still be as high as 69dBA nor how far from the property line the machine would be located. The Planning Board surmised the machine would probably be located at various places on the property. Therefore, the Planning Board requested that Merzi provide the Planning Board with more complete information and documentation.  The noise level should not exceed 60 decibels at the property line. Reference was made to Andover’s Zoning Ordinance; Article X:B.12: “Structures and uses shall be designed, maintained and operated so as not to result in an offsite sound level above 60dBA as measured at the property line. Moyer will address these concerns with Merzi.

As Time Allows
1. The board reviewed the list of Planning Board tasks and priorities
2. Phelps and Urie will work on drafting a Junkyard Ordinance
3. Urie researched Planned Unit Development.  This is permitted by a Special Exception by the Zoning Board of Adjustment in all zones.


There being no further discussion, Urie made a motion to adjourn at 8:50 p.m.  Phelps seconded the motion and the board voted unanimously in favor of adjourning.
