Announcements

The Planning Board budget must be submitted to Town Administrator Marj Roy no later than September 30.

Nancy and Marj Roy will be attending a Law Series Lecture on October 15 pertaining to All Things Planning Board.

Planning and Zoning Coordinator

Moyer has been working on updating the driveway permits and has been filing and finding documents pertinent to Planning Board issues.

Zoning Administrator

Dave received a complaint of a possible junkyard on Franklin Highway and upon going to the property, the property has been cleared of items.

Capital Improvement Planning

Doug Phelps advised the board of the progress by the Capital Improvement Planning Committee. they are in the process of working through items for the school. The Superintendent of SAU46 will be present at the September 29, meeting of the committee.

The committee has received recommendations regarding a police cruiser and a grader.

The committee has received a list of projects from the Road Agent for work proposals for the next seven years.

Randall will present the program of energy and cost efficiency improvements to the Town Hall proposed by the Andover Alternative Energy Group.

A request for a fence around the East Andover cemetery has been withdrawn.

Bog Pond: Conservation Commission

Broshek gave a brief background regarding conservation easements. The Conservation Committee seeks to establish an easement for the area around Bog Pond owned by the Town and notes that owners of two adjoining parcels with pond frontage, Belletetes and Ron Charles, had also expressed interest in contributing easements on their land.

Broshek distributed a hand-out pertaining to the proposed next steps in creating the easement which includes discussing the proposed easement with Belletetes and Ron Charles; meeting with Ausbon Sargent Land Preservation Trust (ASLPT); and clearly marking the proposed boundaries for the easement.

The commission will put markers to define gravel extraction and processing areas held outside the easement and markers defining the boundary of the proposed easement surrounding the wetland. The commission will prepare a document for the Planning Board regarding the steps entailed in establishing the easement and come back before the Planning Board with Andy Deegan, ASLPT Land Protection Specialist.

Teach stated that the property needs to be surveyed prior to drawing up an easement, and a warrant article will need to be drawn up for Town Meeting in order to approve the easement.

Warzocha asked if ASLPT would bear the money for the easement. Broshek explained that ASLPT, as the future easement holder, may not fund the survey, but the Conservation Commission would expect to be able to pay for it.

Costa asked if the contribution of easements by the adjoining landowners could be coordinated to proceed at the same time, thereby maximizing the reciprocal benefit to the interested parties and the Town.

Warzocha asked if there had been any discussion regarding public access to the area of the proposed easement.

John Thompson asked that the boundary of the proposed easement be clarified, especially in the area of the Town’s gravel extraction and processing, to provide that the Town would be able to continue its current and planned gravel activities.

Broshek replied that this is what is intended at the next stage – agreeing on the ground a boundary of the easement that would both protect the pond and allow the Town to continue to make use of the gravel resource until finished.

Warzocha stated he would want to see a survey before he could approve a boundary.

34 Tucker Mountain Road Driveway

Road Agent John Thompson stated that a previously-approved driveway has been put in; however, procedures were not followed. He asked how he should proceed.

The board responded that a letter needs to be drawn up by Thompson and Powers and mailed to the property owner indicating that the regulations are not being followed and corrective action needs to be taken.

Powers will get a photo of the driveway, mark it up in regards to the violation(s), and send it to the property owner along with the letter.

121 Channel Road: Non-Binding Consultation

Ethney McMahon stated to the Board that they are interested in purchasing the property and presented a diagram of the property indicating the current footprint and the proposed footprint for the home they are considering building.

The property is 0.19 acres, and members of the Board were concerned that they would not meet the 50’ setback for shoreland permit if enlarging the footprint of the home and recommended as a possible next step that the buyers consult with a shoreland permitting expert.

Potential alternatives to meet the 50’ setback requirement while not violating other setbacks were discussed.

Policies and Fees

The Select Board will act on the draft of schedule of fees, lot merger application, and driveway permit application.
