Change in State Election Law Eliminates ID Exceptions

Be prepared to register to vote; know the changes

In September 2024, Governor Sununu signed into law NH HB1569, which went into effect on November 11, 2024. This bill removes any exceptions for proving voter identification, domicile, and citizenship. To register to vote you must provide documentation that proves your identity, age, citizenship, and domicile in the town where you seek to vote:

 

  1. You must prove your identity.  A driver’s license or non-driver ID from any state is proof of identity and age. A driver’s license or non-driver ID is also proof of domicile if the listed address matches the domicile address you enter on the voter registration form. Your passport can also prove your identity, citizenship, and age. 

 

  1. You must prove your citizenship. A birth certificate, US Passport/Passport card, or naturalization document is proof of citizenship and age. If the name on your birth certificate or passport does not match your current ID, you will also need to bring in documentation of the name change (e.g., marriage license or court order).

 

  1. You must prove your domicile. A government issued document such as a vehicle registration, a tax document, a check, benefit statement, that has the same address as the domicile address you entered on the voter registration form is also proof of domicile. A utility bill or rental agreement is also considered proof of domicile.

 

If you cannot prove your identity, you may be identified by the Town Clerk, or Assistant Town Clerk, the Moderator or Deputy Moderator, a Supervisor of the Checklist, or a member of the Select Board. 

If you cannot prove your domicile, you may fill out a special “Attestation of Not Possessing Qualified Domicile Proof Documents.”

If you have left documentation at home or in your car, you will be asked to retrieve your documentation. 

If you cannot prove your citizenship, age, or identity (and the election officials listed above cannot identify you), you will not be allowed to register or vote.
